Terms of Service | The Local's Choice

1. Acceptance of Terms

By accessing or using The Local's Choice website ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. These terms apply to all visitors, business owners, and any other users of the Platform.

2. What We Provide

The Local's Choice is an online directory that connects residents with local home service businesses. We provide a platform for businesses to create listings and for residents to discover and contact those businesses. We are not a party to any agreement between a user and a business, and we do not provide the services listed.

3. Business Listings

Business listings require an approved application and an active paid subscription ($65 CAD/year).
You must provide accurate and truthful information in your application and listing.
We reserve the right to approve, reject, suspend, or remove any listing at our sole discretion.
The Local's Choice badge ("Local's Choice") is awarded at our discretion based on criteria including but not limited to Google rating and community engagement. We may remove the badge at any time.
You are responsible for keeping your listing information current and accurate.

4. Subscriptions and Payments

Subscriptions are billed annually. Payment is processed securely through Stripe.
Subscriptions automatically renew unless cancelled before the renewal date.
Refunds are not provided for partial subscription periods.
If a payment fails, your listing may be suspended until payment is resolved.

5. Acceptable Use

You agree not to:

Submit false, misleading, or fraudulent information.
Upload content that is illegal, offensive, defamatory, or infringes any third-party rights.
Use the Platform to spam, harass, or solicit other users.
Attempt to gain unauthorized access to any part of the Platform.
Use automated tools to scrape or collect data from the Platform without our written consent.

6. User Content

By uploading photos, videos, descriptions, or other content to the Platform, you grant The Local's Choice a non-exclusive, royalty-free license to display and use that content in connection with operating the Platform. You represent that you own or have the necessary rights to all content you submit.

7. Quote Requests

When a visitor submits a quote request through a business's listing, their contact information is forwarded directly to that business. The Local's Choice is not responsible for the response time, quality of service, or any outcome of engagements between users and businesses.

8. Disclaimers

The Platform is provided "as is" without warranties of any kind. We do not verify the licensing, insurance, or qualifications of listed businesses beyond the information they provide. Always conduct your own due diligence before hiring a service provider. The Local's Choice is not liable for any damages arising from your use of the Platform or your interactions with businesses found through it.

9. Limitation of Liability

To the fullest extent permitted by applicable law, The Local's Choice shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account or listing at any time for violation of these Terms or for any other reason at our sole discretion. You may cancel your subscription at any time through your dashboard.

11. Governing Law

These Terms are governed by the laws of British Columbia, Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts of British Columbia.

12. Changes to Terms

We reserve the right to update these Terms at any time. We will post the revised Terms on this page with an updated date. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
